Battery storage rules nationwide
The federal + model-code floor applies everywhere in the US. No state or locality drops below it; they only add to it. It is the uniform safety baseline every AHJ starts from — largely enabling for BESS, with worker-safety, environmental, and market rules layered on top.
Model codes and standards
- NFPA 855 (2020 / 2023 / 2026 — published Sept 2025)
- IFC §1207 / Chapter 12 (2024)
- IRC Chapter R328 (2021)
- UL 9540
- UL 9540A (6th ed., Mar 2026)
- UL 1973
- UL 1741 / 1741SB
- NEC / NFPA 70 Art. 706
- NFPA 68 / 69 / 72 / 13
How a project is permitted
Your local AHJ enforces the model codes (NFPA 855 + the adopted IFC/IRC edition). A federal nexus (federal land, funding, or permit) triggers NEPA review; EPA leads post-incident cleanup. Military installations follow their own criteria: there the Unified Facilities Criteria serve as the fire code, with unoccupied BESS structures at least 100 ft from occupied structures (UFC 3-600-01) and lithium-ion not allowed in occupied buildings (UFC 3-520-01); confirm the current UFC with the installation's fire authority (PNNL-36330 §5, Aug 2024).
Setbacks and spacing
- No federal civilian siting setback. FPRF-2019 tested separation: LFP ~3–6 ft vs LNO/LMO up to 13 ft. Fire-test based NFPA ESS Fact Sheet (Feb 2024) / FPRF 2019
Legislation
- OSHA 29 CFR 1910 + General Duty Clause §5(a)(1): No Li-ion-specific standard; general-industry rules + the General Duty Clause are the worker-safety floor in every state. PSM, HazCom, HAZWOPER, and LOTO apply. OSHA FS-4480 (01/2025)
- RCRA / TSCA / EPCRA / CWA §404: EPA framework: hazardous-waste handling, battery chemicals, inventory reporting to local responders, and post-incident cleanup/decommissioning. 42 U.S.C. §6901 et seq. (RCRA); 15 U.S.C. §2601 et seq. (TSCA); 42 U.S.C. §11001 et seq. (EPCRA); 33 U.S.C. §1344 (CWA §404)
- NEPA / NHPA §106 / ESA §7: Federal environmental review triggered when a federal nexus exists (federal land, funding, or permit). 42 U.S.C. §4321 et seq. (NEPA); 54 U.S.C. §306108 (NHPA §106); 16 U.S.C. §1536 (ESA §7)
