Battery storage rules: Nevada
Nevada's State Fire Marshal moved the state fire code from the 2018 to the 2024 International Fire Code (IFC), enforced from January 1, 2026 (Adopted Regulation R205-24; fire.nv.gov Hot Topics). Clark County adopted the 2024 IFC with local amendments, none of which touch energy storage (Clark County Ordinance 5321). A September 2025 fire at a Boulder City solar-plus-storage site involved 2 battery units, with no injuries (Fox5 Las Vegas reported). Siting rules are set largely at the county level.
No state moratorium: ask your county about local rules
No Nevada law pauses battery storage projects. Ask your county planning department whether a local pause on energy project applications is in effect, and whether it covers battery storage.
Fire and building codes in force
- State: 2024 IFC with appendices B, C, D, F and H, adopted by reference in NAC 477.281(1)(a), replacing the 2018 edition (Adopted Regulation R205-24, Sec. 9). Enforced from January 1, 2026 (fire.nv.gov Hot Topics).
- Ask your fire code official whether NFPA 855 applies to your project through the IFC's references; it is not on the state's list of adopted NFPA standards in NAC 477.281.
- Local: local governments may adopt stricter codes (NAC 477.280). Clark County adopted the 2024 IFC on December 2, 2025 (Ordinance 5321), effective January 2026, with no amendments to Section 1207 (Clark County 2024 IFC Amendments). The joint Southern Nevada amendments (Clark County, Henderson, Las Vegas, North Las Vegas, Boulder City, Pahrump, Mesquite) mention energy storage only in a recordkeeping list at Section 110.3 (City of Las Vegas, 2024 Southern Nevada Fire Code Amendments, 04-08-25).
- IFC Section 1207 applies as published in the 2024 IFC where no local amendment changes it (R205-24; Clark County amendments). Ask your local fire department about Washoe County and Reno.
How a project is permitted
Under the Utility Environmental Protection Act (UEPA), anyone other than a local government needs a Public Utilities Commission of Nevada (PUCN) permit before building a "utility facility" (PUCN UEPA page). NRS 704.860 excludes renewable generating plants of 70 MW or less. Ask the PUCN whether your standalone storage project needs a UEPA permit. Counties issue land use permits.
Setbacks and spacing
- No state setback beyond the model IFC. Ask your county planning department whether a setback applies to battery storage; for example, ask Nye County whether the 1-mile residential setback in Ordinance 611 applies to batteries or only to solar arrays. Local ordinance Nevada Administrative Code Chapter 477; Nye County Ordinance 611
Reported incidents
- Townsite Solar, Boulder City, September 2025: Fox5 Las Vegas reported that 2 of 114 battery units burned, with no injuries, and that crews from Boulder City, Henderson and Clark County protected exposures. The cause was not reported. Fox5 Las Vegas, 2025-09-24
