Battery storage rules: Philadelphia, PA

Last checked against primary sources: October 27, 2026

Philadelphia's fire code (Subcode F of Title 4) is based on the 2018 International Fire Code, with local amendments (Bill No. 181006, signed July 3, 2019); the city refers to the 2021 IFC where the 2021 building codes reference it. The 2021 building codes are mandatory for permit applications received on or after July 1, 2026. Battery systems need a permit under the Philadelphia Administrative Code. Ask the Department of Licenses and Inspections and the Fire Marshal which requirements apply.

No statewide pause; townships are adopting battery storage zoning

There is no statewide moratorium. Since 2025 several townships and a county have adopted battery storage rules, mostly as a conditional use allowed only in certain zoning districts, with setbacks and NFPA 855 requirements. Ask your township or county whether its zoning addresses battery storage, and whether any pause is in effect. e.g. Buffalo Twp Ord. 114 of 2025; Susquehanna Co. Ord. 2026-04; Dickinson Twp Ord. 2026-03; Hemlock Twp Ord. 9-8-26; West Hanover Twp Ord. 2026-01

Fire and building codes in force

How a project is permitted

Local zoning (a conditional use or special exception in the township's zoning ordinance) or county land-development review, plus a building permit under the Uniform Construction Code from the municipality's code official (or from Labor & Industry or its contracted agency where the municipality does not enforce the code). Ask your township or county planning office whether its zoning or land-development ordinance addresses battery storage. Ask your code official which parts of the fire code's energy storage section (IFC Section 1207) a building permit review applies, and your fire code official which fire code, and which NFPA 855 edition if any, the municipality enforces. Where the Department of Labor & Industry enforces the code, ask it whether a standalone outdoor battery enclosure needs a construction code permit.
