Battery storage rules: East Hanover Township (Dauphin County), PA

Last checked against primary sources: October 28, 2026

East Hanover Township, Dauphin County, makes data centers and battery storage a conditional use only in the Industrial Commercial (IC) and IC-1 districts, on at least 20 contiguous acres (Ordinance No. 2026-02, enacted August 18, 2026). At the August 18 hearing, the township solicitor summarized the ordinance as also covering a hazardous materials plan, an emergency management response plan, approvals from DEP and the local water and sewer authorities, a decommissioning plan and an annual operating compliance report (Board of Supervisors minutes). Ask the township which of these apply to battery storage, and which fire code and NFPA 855 edition apply.

Fire and building codes in force

How a project is permitted

Local zoning (a conditional use or special exception in the township's zoning ordinance) or county land-development review, plus a building permit under the Uniform Construction Code from the municipality's code official (or from Labor & Industry or its contracted agency where the municipality does not enforce the code). Ask your township or county planning office whether its zoning or land-development ordinance addresses battery storage. Ask your code official which parts of the fire code's energy storage section (IFC Section 1207) a building permit review applies, and your fire code official which fire code, and which NFPA 855 edition if any, the municipality enforces. Where the Department of Labor & Industry enforces the code, ask it whether a standalone outdoor battery enclosure needs a construction code permit.
